Continuing Extension Act of 2010

The Continuing Extension Act of 2010 was signed into law on April 15, 2010, extending the COBRA and Mini-COBRA subsidy eligibility period through May 31, 2010. Therefore, individuals who had an involuntary termination of employment, including those who had a reduction in work hours followed by an involuntary termination of employment, from April 1, 2010 through May 31, 2010, are now eligible for the subsidy.

We previously asked employers not to send any notices to individuals who had a qualifying event on or after April 1, 2010 until we heard more about this possible extension. Now that the subsidy has been extended, employers should send the appropriate updated notice to ALL individuals who had a qualifying event from April 1, 2010 through May 31, 2010, as outlined below:

  • For individuals who had a qualifying event from April 1, 2010 through April 14, 2010, employers should send the appropriate notice below as soon as possible, but no later than 60 days after the date of the qualifying event.
  • For individuals who had a qualifying event from April 15, 2010 through May 31, 2010, employers should send the appropriate notice below within 14 days of the qualifying event, as is usually required.

Note: If employers have already sent a notice to any of these individuals without information about the extension through May 31, 2010, they will need to resend the appropriate updated notice below.
