Update to All-Payer Claims Database Submissions for Self-funded Accounts with ERISA Plans

As of March 28, 2016, we will no longer submit data to any state's All-Payer Claims Database (APCD) for any self-funded account with an Employee Retirement Income Security Act (ERISA) plan.

Earlier this month, the Supreme Court ruled that ERISA pre-empts the reporting obligations imposed by state All-Payer Claims Databases on ERISA plans, including their Third-Party Administrators. As a result, we will not be submitting data from self-funded ERISA plans unless we receive explicit instruction to do so from an account.
